Welcome to TrotIQ. These Terms of Service ("Terms") govern your access to and use of the TrotIQ mobile application, website, subscriptions, AI analysis, coaching, progress tracking, calendar, notes, to-do, horse profile, and related services operated by Align Systems ("Company", "we", "us", or "our"). By downloading, installing, accessing, purchasing, subscribing to, or using TrotIQ, you agree to these Terms and our Privacy Policy.

1. Eligibility and Responsible Use Around Horses

You must be at least 13 years old to use TrotIQ. If you are under 18, use the Service only with parent or guardian permission and supervision. Horse riding and horse care involve inherent risks. You are responsible for safe decisions, appropriate equipment, qualified supervision, and following local rules, stable policies, competition rules, and professional guidance.

2. What TrotIQ Provides

  • AI-assisted riding video analysis, technique feedback, frame-based observations, and training recommendations.
  • Horse-condition and movement observations intended to help you notice possible areas to review with a professional.
  • AI coaching chat, training drills, educational content, progress tracking, streaks, session library, and score summaries.
  • Calendar, notes, to-do lists, horse profiles, care tracking, and stable management tools.
  • Free and paid subscription features, including TrotIQ Pro where available.

3. AI, Veterinary, Coaching, and Safety Disclaimer

TrotIQ uses artificial intelligence and automated analysis. AI outputs may be incomplete, delayed, inaccurate, or inappropriate for your specific horse, rider, environment, tack, surface, health condition, or training context. TrotIQ is for informational and educational purposes only. It is not veterinary advice, medical advice, diagnosis, emergency advice, certified coaching, professional training instruction, legal advice, or a substitute for qualified human judgment.

Always consult a licensed veterinarian for horse health, pain, lameness, injury, welfare, medication, or emergency concerns. Always consult a qualified riding instructor, trainer, or other appropriate professional before changing training, tack, workload, or care plans. Stop riding and seek professional assistance if there is any safety concern.

4. Accounts, Local Profiles, and Accuracy

TrotIQ may allow you to create a local profile and store riding goals, horse details, sessions, notes, and preferences on your device. You are responsible for keeping information accurate and backing up anything important. We are not responsible for lost local data caused by device loss, uninstalling the App, clearing storage, operating system issues, or events outside our control.

5. Subscriptions, Trials, and In-App Purchases

TrotIQ may offer free features and paid subscriptions such as TrotIQ Pro. Subscription availability, trial periods, features, limits, and pricing may vary by region, platform, offer, and time.

  • Payment is charged to your Apple ID or Google Play account when you confirm purchase.
  • Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current billing period, or as otherwise stated by Apple or Google.
  • Your account may be charged for renewal within 24 hours before the end of the current period at the then-current subscription price.
  • You can manage, cancel, or restore purchases through Apple App Store or Google Play account settings. Deleting the App does not cancel a subscription.
  • Refund requests must be directed to Apple or Google according to their refund policies. We do not control store refunds or provide partial-period refunds unless required by law.
  • If a free trial is offered, unused trial time may be forfeited when you purchase a subscription, subject to store rules.

6. User Content and License to Process It

You retain ownership of videos, images, notes, prompts, horse information, session data, and other content you upload, enter, or create in TrotIQ. You grant us a limited, worldwide, non-exclusive, royalty-free license to host, transmit, copy, analyze, transform, display, and otherwise process User Content only as reasonably necessary to operate, provide, secure, troubleshoot, and improve the Service, including generating AI analysis, thumbnails, summaries, coaching responses, and support diagnostics.

You represent that you have all rights and permissions needed to upload User Content, including consent from identifiable people appearing in videos or images where required.

7. Acceptable Use

  • Do not use the Service unlawfully, deceptively, abusively, or in a way that could harm riders, horses, animals, minors, third parties, or Align Systems.
  • Do not upload illegal, infringing, harassing, hateful, sexually explicit, exploitative, violent, malicious, or privacy-violating content.
  • Do not use TrotIQ to diagnose, treat, or make emergency decisions for a horse without qualified professional care.
  • Do not reverse engineer, decompile, scrape, copy, resell, sublicense, or build a competing service from the App or its outputs except where law expressly allows.
  • Do not interfere with security, subscriptions, payments, AI systems, infrastructure, or other users, and do not bypass paid features.
  • Do not misrepresent AI outputs as professional certification, veterinary diagnosis, guaranteed results, or official competition assessment.

8. Intellectual Property

The Service, including software, design, interface, graphics, logos, trademarks, text, training content, generated templates, and materials provided by us, is owned by Align Systems or our licensors. Subject to these Terms, we grant you a personal, limited, revocable, non-exclusive, non-transferable license to use the Service for lawful personal, non-commercial equestrian training and horse-care purposes.

9. App Stores and Platform Terms

If downloaded from the Apple App Store, Apple is not a party to these Terms, has no obligation to provide maintenance or support, and is not responsible for claims related to the App. Apple and its subsidiaries are third-party beneficiaries of app-store-specific provisions and may enforce them. If downloaded from Google Play, Google is not responsible for the Service except as required by Google Play terms or law. Your use is also subject to applicable Apple App Store or Google Play terms.

10. Privacy and Third-Party Services

Our Privacy Policy explains how information is collected, used, disclosed, retained, and deleted. TrotIQ may rely on third-party services for AI processing, subscriptions, payments, analytics, advertising attribution, infrastructure, diagnostics, and support. We are not responsible for third-party services, store outages, AI provider outages, model changes, payment processor decisions, or external links, except where required by law.

11. Availability, Changes, and Termination

We may modify, suspend, limit, or discontinue any part of the Service at any time, including features, usage limits, AI models, supported platforms, and subscription offerings. We may suspend or terminate access if you violate these Terms, create risk, misuse the Service, fail to pay, or where required for legal, security, or operational reasons. Termination does not automatically cancel store subscriptions.

12. No Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TROTIQ IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SAFETY, OR RELIABILITY. We do not warrant that AI analysis will be correct, improve riding performance, prevent injury, identify lameness, replace professional advice, operate uninterrupted, or be free of errors or data loss.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALIGN SYSTEMS AND ITS SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, PERSONAL INJURY, ANIMAL INJURY, PROPERTY DAMAGE, TRAINING DECISIONS, VETERINARY DECISIONS, BUSINESS INTERRUPTION, OR LOSS OF GOODWILL ARISING FROM OR RELATED TO THE SERVICE. OUR TOTAL LIABILITY WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID THROUGH THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM OR USD $100.

14. Indemnification

You agree to defend, indemnify, and hold harmless Align Systems and its affiliates, officers, directors, employees, contractors, licensors, and service providers from claims, liabilities, damages, losses, and expenses arising from your User Content, use of the Service, violation of these Terms, violation of law, or infringement of third-party rights.

15. Governing Law, Disputes, and General Terms

These Terms are governed by the laws of the jurisdiction in which Align Systems operates, without regard to conflict-of-law rules, unless mandatory consumer protection laws require otherwise. Before bringing a formal claim, contact us and attempt to resolve the dispute informally. If any provision is unenforceable, the remaining provisions remain in effect. These Terms, the Privacy Policy, and in-app subscription disclosures form the entire agreement regarding TrotIQ.
